This book began as a roundtable at the Annual Meeting of the American Society of International Law, and I am grateful to the Society for its efforts to stimulate critical debate. The Institute for Global Law and Policy at Harvard Law School provided a forum for the contributors at the half-way point, and we are deeply indebted to its Faculty Director, David Kennedy.
